Terms of Service
Effective January 2026
These Terms of Service ("Terms") govern your use of Pulse and its related services (the "App") operated by Kleyn Studio (Pty) Ltd ("Company", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By using Pulse, you confirm that you are at least 13 years of age or the legal age of majority in your jurisdiction, whichever is greater. If you are under 13, you may not use this App.
If you do not agree to these Terms in their entirety, you may not access or use the App.
2. Account and Relationship Management
Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Partner Linking: To establish a relationship connection, your partner must provide explicit consent to pair with you. You may not attempt to pair with anyone without their knowledge or consent.
One Relationship Limit: Each account can only maintain one active relationship at a time. Starting a new relationship will end your current one.
3. Acceptable Use Policy
You agree not to use Pulse to:
- Harass, abuse, threaten, or intimidate your partner or other users
- Attempt to access the App through unauthorized means or methods
- Scrape, crawl, or extract data from the App
- Transmit viruses, malware, or other harmful code
- Spam or send unsolicited communications
- Violate any applicable laws or regulations
- Impersonate another user or misrepresent your identity
4. Content and Intellectual Property
Your Content: You retain all rights to any content you create within Pulse (including mood check-ins, profile information, and messages). By using Pulse, you grant us a limited license to process, store, and display your content as necessary to provide the App's functionality.
App Ownership: The Pulse application, including its design, code, branding, and features, is owned by Kleyn Studio (Pty) Ltd. You are granted a personal, non-exclusive, non-transferable license to use the App for its intended purpose.
Restrictions: You may not modify, reproduce, distribute, or create derivative works of Pulse without explicit permission from Kleyn Studio (Pty) Ltd.
5. Service Availability
No Uptime Guarantee: While we strive for reliability, we do not guarantee uninterrupted or error-free access to Pulse.
Maintenance and Updates: We may modify, suspend, or discontinue any aspect of the App at any time, with or without notice. We will attempt to provide notification of significant service interruptions.
Your Access Risk: You use Pulse at your own risk. Any interruption in service is not our responsibility.
6. Limitation of Liability
As-Is Service: Pulse is provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties, including accuracy, fitness for purpose, and non-infringement.
Not a Substitute for Professional Help: Pulse is a communication tool designed for couples check-ins. It is not a substitute for professional therapy, counseling, or medical advice. If you or your partner are experiencing emotional distress, please consult a qualified professional.
No Liability for Outcomes: We are not responsible for relationship outcomes, decisions made based on App data, or any indirect damages resulting from your use of Pulse.
7. Termination
User Termination: You may delete your account and discontinue your use of Pulse at any time through the Settings section of the App. Account deletion is permanent and cannot be undone.
Company Termination: We may terminate or suspend your account immediately if we determine you have violated these Terms or engaged in prohibited conduct.
Data Deletion: Upon account termination, all data associated with your account will be deleted in accordance with our Privacy Policy.
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in South Africa for the resolution of any disputes.
9. Changes to These Terms
We may modify these Terms at any time. When we do, we will update the "Effective" date at the top of this document. Your continued use of Pulse after such modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
10. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Kleyn Studio (Pty) Ltd regarding your use of Pulse. If any provision of these Terms is invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.
